Persons holding a politically exposed position within the meaning of the Act are, with the exception of groups of middle and lower level positions, persons holding significant public positions or performing significant public functions, including:

  • heads of state, heads of government, ministers, deputy ministers and secretaries of state,
  • members of parliament or similar legislative bodies,
  • members of the governing bodies of political parties,
  • members of supreme courts, constitutional courts and other high-level judicial bodies whose decisions are not subject to appeal, with the exception of extraordinary procedures,
  • members of courts of auditors or central bank boards,
  • ambassadors, chargés d'affaires and senior officers of the armed forces,
  • members of administrative, management or supervisory bodies of state enterprises, companies with State Treasury shareholding, in which more than half of the shares or stocks belong to the Treasury State Treasury or other state legal persons,
  • directors, deputy directors and members of the organs of international organisations or persons exercising equivalent functions within those organisations,
  • directors general in the offices of the chief executive and central state authorities and directors general directors of provincial offices,
  • other persons holding public office or performing public functions in state bodies or central government administration bodies.

Family members of a politically exposed person within the meaning of the Act are:
  • spouse or cohabitant of a politically exposed person politically exposed person,
  • a child of a politically exposed person and his or her spouse or a person cohabiting partner,
  • parents of a politically exposed person.

Close associates of a politically exposed person within the meaning of the Act are:
  • natural persons who are the beneficial owners of legal persons, unincorporated entities or trusts unincorporated entities or trusts jointly with a politically exposed person or with a person holding such a person politically exposed person or having other close relations with that person in relation to the exercise of a business activity. economic activities,
  • natural persons who are the sole beneficial owner of a legal person, an unincorporated entity or a trust known to be an unincorporated entity or a trust known to have been established for the purpose of obtaining an effective benefit from a politically exposed person political.
